All REALTORS® vow to uphold the REALTORS® Code of Ethics.
The Code is a living document, preserving its relevance and usefulness despite the passing of years and the changing of times.
If you feel that a violation of the Code of Ethics has occurred, please do the following
1) Download the Form E#1, Ethics Complaint Form, and complete.
2) Submit the completed form, along with any supporting documentation, to your local REALTOR® Association office. These documents and form are known as The Complaint. Please note, the alleged violation must have taken place within the past 180 days.
The process that follows is outlined in the Code of Ethics and Arbitration Manual, but here is a greatly simplified verson.
The board will arrange for a Grievance Committee meeting. The Grievance Committee is comprised of REALTORS® specifically trained in these matters. The Grievance Committee does not decide the matter, but determines if the matter should be forwarded to the Professional Standards Committee.
If the Grievance Committee dismisses The Complaint, you can appeal. If The Complaint is advanced to the Professional Standards Committee, the person(s) named in the complaint are contacted by the Board office with a copy of The Complaint.
The office will request that Form E#3 be completed and attached to any supporting documentation. These documents are then known as The Response. The Response is copied and sent to the Complainant and we proceed to the hearing.
Each party is given due process during the procedure, and is allowed to challenge panel members and to bring witnesses, counsel, etc. The goal of this process is to be fair to all.
